Vous souhaitez reprendre ou créer une entreprise ? Pour bien démarrer votre activité, l’aide aux créateurs et repreneurs d’entreprise (ACRE, ex-ACCRE) vous permet d’être exonéré de cotisations sociales sous conditions.
Depuis le 1er janvier 2019, l’ACCRE (aide aux demandeurs d’emploi créant ou reprenant une entreprise) est devenue l’ACRE (aide aux créateurs et repreneurs d’entreprise) et est étendue à tous les créateurs et repreneurs d’entreprise.
Qu’est-ce que l’aide aux créateurs et repreneurs d’entreprise (ACRE) ?
L’aide aux créateurs et repreneurs d’entreprise (ACRE) est une exonération partielle ou totale des charges sociales pendant un an.
Quel est le montant de l’exonération ?
Les cotisations sociales exonérées sont : les cotisations patronales et salariales correspondant à l’assurance maladie, maternité, retraite de base, invalidité décès, aux prestations familiales.
Les cotisations non concernées par l’ACRE sont : les cotisations relatives à la contribution sociale généralisée (CSG), au risque accident du travail, à la retraite complémentaire obligatoire, à la formation professionnelle.
L’exonération est :
- totale pour un revenu professionnel inférieur à 30 393 €
- dégressive pour un revenu professionnel compris entre 30 393 € et 40 524 €.
Si le revenu supérieur à 40 524 €, il n’y a pas d’exonération.
Depuis le 1er janvier 2019, l’ACCRE (aide aux demandeurs d’emploi créant ou reprenant une entreprise) est devenue l’ACRE (aide aux créateurs et repreneurs d’entreprise) et est étendue à tous les créateurs et repreneurs d’entreprise.
Il ne faut cependant pas avoir bénéficié de l’ACCRE durant les 3 ans précédant la demande.
Conditions pour être éligible à l’ACRE liées à l’entreprise créée
En reprenant ou créant une entreprise, le bénéficiaire doit respecter les conditions suivantes :
- L’entreprise doit être une entreprise individuelle ou une société
- Le bénéficiaire doit exercer le contrôle effectif de l’entreprise : soit en détenant plus de 50 % du capital, soit en étant le dirigeant de la société et en détenant au minimum 1/3 du capital, sous réserve qu’un autre associé ne détienne pas plus de la moitié du capital
A noter : plusieurs personnes peuvent demander séparément l’ACRE pour un seul et même projet de reprise ou création d’entreprise à condition :
- qu’elles détiennent collectivement plus de 50 % du capital
- qu’une ou plusieurs d’entre elles ait la qualité de dirigeant
- et que chaque demandeur détienne au moins 1/10e de la fraction du capital détenue par la personne qui possède la plus grande part de capital
